Melissa Anne Herbert focuses her practice on the defense of management in all stages of employment and labor law litigation in both state and federal court.  To that end, Ms. Herbert defends litigation brought under federal employment discrimination statutes such as Title VII, the ADEA, the ADA, the FMLA, and New Jersey equivalents including the LAD, CEPA and the FLA.  In addition to litigation practice, Ms. Herbert counsels  employers on employee handbooks, policies, performance improvement plans, disciplinary materials and separation agreements and releases.  While clerking in the District of New Jersey, Ms. Herbert dealt exclusively with discovery motion practice and handling discovery issues.
